Purchasing a house during the housing boom is not a legitimate hardship.&amp;nbsp; Purchasing a house during the housing boom and being unable to pay your mortgage &lt;em&gt;&lt;i&gt;&lt;font face=Arial&gt;&lt;span style='font-family:Arial'&gt;is&lt;/span&gt;&lt;/font&gt;&lt;/i&gt;&lt;/em&gt; a hardship.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p style='line-height:15.0pt;background:#FEFEFE'&gt;&lt;font size=1 color="#333333" face=Arial&gt;&lt;span style='font-size:9.0pt;font-family:Arial;color:#333333'&gt;Strategic default is never a good idea! Banks actually analyze short sale sellers&amp;#8217; hardships, and most center on the economy, so the bank is going to make sure that a short sale is in their own best interest.&amp;nbsp; Acceptable hardships include medical issues, divorce, and disability, significant loss of income, death, unemployment, and relocation.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;  &lt;/article&gt;  &lt;p class=MsoNormal style='mso-margin-top-alt:auto;margin-bottom:.1in; background:#FEFEFE'&gt;&lt;font size=4 color="#333333" face=Arial&gt;&lt;span style='font-size:15.0pt;font-family:Arial;color:#333333'&gt;Laws are local&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p style='line-height:15.0pt;background:#FEFEFE'&gt;&lt;font size=1 color="#333333" face=Arial&gt;&lt;span style='font-size:9.0pt;font-family:Arial;color:#333333'&gt;It&amp;#8217;s important to know your state&amp;#8217;s foreclosure laws because there are currently no national short sale laws on the books.&amp;nbsp; There are federal guidelines, but they can be applied when and how a bank wants.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p style='line-height:15.0pt;background:#FEFEFE'&gt;&lt;font size=1 color="#333333" face=Arial&gt;&lt;span style='font-size:9.0pt;font-family:Arial;color:#333333'&gt;States, however, can either have recourse loans or non-recourse loans.&amp;nbsp; A recourse loan allows the bank to demand a borrower pay the difference between what the properties are sold for and what is owed on the lien.&amp;nbsp; Many recourse states allow lien holders (banks) to pursue judgment liens against the borrower for the deficiency amount.&amp;nbsp; This process allows the bank to garnish a borrower&amp;#8217;s wages until the debt is paid off.&amp;nbsp; Garnishments can be as much as 25% of non-exempt disposable earnings, and bankruptcy doesn&amp;#8217;t always save a defaulted borrower from judgment liens.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p style='line-height:15.0pt;background:#FEFEFE'&gt;&lt;font size=1 color="#333333" face=Arial&gt;&lt;span style='font-size:9.0pt;font-family:Arial;color:#333333'&gt;Real estate agents are not allowed to practice law, unless they are actually licensed to do so. However, agents do need to be aware of possible penalties for short selling a home and also be able to direct their clients to the right resources to discuss the possible consequences and solutions.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt; always starts sometime in August.&amp;nbsp; This year school starts August 16&lt;sup&gt;th&lt;/sup&gt;.&amp;nbsp; &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/font&gt;&lt;/b&gt;&lt;/strong&gt;&lt;/p&gt;  &lt;p class=MsoNormal&gt;&lt;strong&gt;&lt;b&gt;&lt;font size=3 face="Times New Roman"&gt;&lt;span lang=EN style='font-size:12.0pt'&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/span&gt;&lt;/font&gt;&lt;/b&gt;&lt;/strong&gt;&lt;/p&gt;  &lt;p class=MsoNormal&gt;&lt;font size=3 face="Times New Roman"&gt;&lt;span lang=EN style='font-size:12.0pt'&gt;This year &lt;st1:place w:st="on"&gt;&lt;st1:State w:st="on"&gt;Florida&lt;/st1:State&gt;&lt;/st1:place&gt; will have the Sales Tax holiday.&amp;nbsp; These have gained in popularity in recent years, in part because of the economy but mostly because everyone wants to get a good deal, and more and more states are starting to get in the fun.&amp;nbsp; I have information on what &lt;st1:State w:st="on"&gt;&lt;st1:place w:st="on"&gt;Florida&lt;/st1:place&gt;&lt;/st1:State&gt; gives you a tax breakon but if you ever have a question, the employees of the stores know what it applies to.&lt;strong&gt;&lt;b&gt;&lt;font face="Times New Roman"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/font&gt;&lt;/b&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p class=MsoNormal&gt;&lt;strong&gt;&lt;b&gt;&lt;font size=3 face="Times New Roman"&gt;&lt;span lang=EN style='font-size:12.0pt'&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/span&gt;&lt;/font&gt;&lt;/b&gt;&lt;/strong&gt;&lt;/p&gt; How sad that is for the sellers.  Over 88% of buyers are on the internet before they call a realtor.  Seeing a virtual tour is like going to an Open House without leaving your home!  I have found many buyers for my listings just because of the virtual tours.  Also, marketing on the internet in general is the way to go!  Having a listing in a magazine doesn't neccessarily give the exposure you need. Most banks are agreeable to what is known as a Loan Modification. &amp;nbsp;A bank would rather restructure your existing mortgage instead of having you do a short sale or foreclosure.&lt;/span&gt;&lt;/font&gt;&lt;/p&gt; Here is my theory:&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p class=MsoNormal&gt;&lt;font size=3 color=blue face="Century Schoolbook"&gt;&lt;span style='font-size:12.0pt;font-family:"Century Schoolbook";color:blue'&gt;&amp;nbsp;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p class=MsoNormal&gt;&lt;font size=3 color=blue face="Century Schoolbook"&gt;&lt;span style='font-size:12.0pt;font-family:"Century Schoolbook";color:blue'&gt;Back in the frenzy of home sales in 2004 and 2005 there were many people who felt if they didn&amp;#8217;t buy a home then that they would never be able to afford a home. &amp;nbsp;People were offering more money than the houses were listed for. &amp;nbsp;This just continued to inflate our market prices.&amp;nbsp; Some buyers should never have been able to qualify for the home they bought but back then mortgage brokers could get someone a home without any kind documentation or proof of income. &amp;nbsp;They also had adjustable arm mortgages.&amp;nbsp; This took many people by surprise when their mortgage adjusted two years later to &amp;nbsp;&amp;nbsp;$400 or $500 more a month! &amp;nbsp;When these people tried to refinance they found that they could not because prices of homes had come down to below what they purchased their house for. &amp;nbsp;When this happens you have people who can no longer afford their homes but cannot pay the bank all monies owed once they do sell. &amp;nbsp;They have to ask their bank if they will be willing to take a short sale. &amp;nbsp;In layman&amp;#8217;s term this means that the bank will take less money than owed on the mortgage to satisfy the debt due.&lt;/span&gt;&lt;/font&gt;&lt;/p&gt;  &lt;p class=MsoNormal&gt;&lt;font size=3 color=blue face="Century Schoolbook"&gt;&lt;span style='font-size:12.0pt;font-family:"Century Schoolbook";color:blue'&gt;&amp;nbsp;&lt;/span&gt;&lt;/font&gt;&lt;/p&gt; It is something that every buyer should get so they will know what their mortgage payment will be.  It boggles my mind just how many buyers I have met that just don&amp;#39;t ask for this in the early stages of looking for a home.  Even if you haven&amp;#39;t chosen a home, you can still get a ball park idea of what your monthly payment will be.  So many people wait till after they are in contract to find out what their estimate will be.  It is never a good thing to buy a house before first asking your mortgage person to provide you with one based on the figures for the property you are thinking of making an offer on.  By delaying this you may be setting yourself up for what I call &amp;quot;sticker shock.&amp;quot;  &lt;br&gt; &lt;br&gt;You have to consider not just what the numbers on the borrowed sum are but you need to know how much are your home association dues, if any, what are you projected taxes for the coming year and what exactly are the closing costs in the transaction. last two years.  I am not so sure it is where I would put my investment
dollars.  So many of these conversions are just old apartment buildings.
Old plumbing, no sound proofing between walls and floors and old problems.
My feelings are that if the complex is a newer community, let's say built in
2000 or later, than it may not be a bad investment.  But if it is the older
buildings I say that you better look into this further before making an
offer that you wish you never had.  You are inheriting old problems that
were once your landlords to deal with.  LET THE BUYER BEWARE!  How can a
proper Sellers Disclosure, a form that is filled out by sellers in which
they declare any latent defects, be part of the contract?  Remember, the
Landlord never occupied the unit.  I am not bringing the buyers I work with
to these unless they are newer buildings.  I interview the sales person to
see what upgrades will be part of the offer.  If I am not happy with what
they tell me I advise the buyer I am with of all the possible pitfalls.

In 2005 we had so many buyers and so few houses for these folks that the prices of homes skyrocketed!  This year, we have over 20,000 listings here in Central Florida!!!  We are back to old fashion real estate folks!  Remember the days when it took awhile to sell your homes?  Oftentimes past your 6 month contract!  Now we have a 9 month inventory of homes!  WHERE DID ALL THE BUYERS GO???  The sellers are still stuck on last years growth and are having a hard time adjusting to the fact that we are now in a Buyers market.  By the way, a note to the buyers out there:  Sellers are not giving their homes away so don't be ridiculous with your offers.  We still have growth here in Seminole County just not at the speed of light!  Buyers have so much to pick from they are taking thier time to chose their home.  Other buyers are sitting on the fence just not sure what to do!  Many buyers are convinced if they wait awhile they will really get a good deal! This is worth every penny you spend on it!  Here in Central Florida we have seen many homes eaten up by these nasty pests! 

There is a myth out here in Florida.  The myth states that only wood framed homes are in danger of being infested.  That is not true!  Son't fall for that.  I have seen concrete block homes get termites.

You best protection is having a pest inspection company come and check for them and then to do a preventative treatment which should also come with a bond.  Termidor seems to be doing a great job and it is the newest approved chemical to prevent the infestation.

In Florida it is not a matter of if, it's a matter of when!  Protect yourself!  Depending on the size of your home and a few other factors it could cost you as little as $90.00. This person should be certified either by ASHI or FABI.   Inspectors who show that certification are trained to inspect a home properly.  When you are getting ready to make one of the biggest investments in your lifetime you need to be sure that you know what you are getting into.

Some people want to save the few hundred dollars but I am telling you that it is money well spent!  When you are structuring an offer on a property besure to use a contingency clause that will allow you to have the home inspection and that if after the inspections are performed and you are not happy that you can get your earnest money back!  PROTECT yourself!  A nice looking home by al apperances could be a nightmare waiting to happen!  (Remember the movie MONEY PIT? However, it will not be the VERY HOT market it was in 2005.  We have seen a cooling off since late September.  We have more inventory than we have had in a long time.  Houses are staying on the market for longer periods of time.  Buyers may actually have a chance to chose a house they love rather than just grabbing whatever was on the market.  This is good news for FULL SERVICE REALTORS.  The times of Discount Brokers and For Sale By Owner are not so good.  More and more we are seeing the Discount Brokers having the Seller put their house in the Multiple Listing System so that Realtors can show then to their customers.  This is good for both the Buyer and Seller.  The Seller has more exposure and the Buyer has more choices!  This is also a good time for Buyers because they may actually be able to negotiate a purchase price.  I love it because I think this will shake out the realtors who were just in it for a fast buck!  That's good news for the consumer as well as us serious realtors. Did you know that this is a penalty imposed when refinancing as well?

Don't let this happen to you! Make sure that your loan person or broker makes it clear that you do not have one. Many times people do not find out until they get to the closing table. It's too late then unless you want to walk away and then you will have the sellers looking to sue you for the escrow money. One way or another,you lose!

Here is an example: Joe Smoe has a $6,000.00 pre-payment penalty if he pays off his mortgage before three years. Now you and I know not many people wil have the capability of paying thier mortage that quickly but what you may not know is that you will be charged the penalty even if you want to refinance the loan. So if Joe needs cash a year after he secured the mortgage and he decides to refinance he will have to pay that pre-payment penalty. The exception to this is that sometimes if you refinance with the same bank or mortgage company they will remove the penalty.  

Be sure to talk with your realtor and make sure that he or she knows that you are not interested in a pre-payment penalty.  Check with a few mortgage people to see if their company utilizes one. Florida residents: Did you know that Florida is one of the few states in our country that has a homestead exemption? What is it you ask? It is a tax savings on the home that you live in and claim to be your homestead. It could save you a lot of money on your taxes each year.  It deducts $25,000.00 from the value of your home so you are taxed on a lower figure.

Did you know if you close and occupy your homestead by December 31, 2005 you will be able to claim the homestead for the full year? So many times the Buyers I work with tell me they have a "friend" or "family" member who is a mortgage broker and that they are going to use them to obtain their loan. Please! It pays to shop around! Oftentimes there are junk fees and charges that these brokers charge and unfortuantely, it is not until we are at the closing table that I find out. It's too late then to find out you have just been ripped off!

My advise, shop around! For instance, I have a Loan Originator who has an office in the same building that I am in. When the Buyers I am working with counsel him he almost always beats out the competitor with rates and pricing.  It's free and you owe no obligation so why not get a couple of different quotes?
